These Terms of Service govern your use of BrookfieldWatch.com and any contribution you make to Brookfield Watch through this website. By using the website or submitting a contribution, you agree to these Terms.

About Brookfield Watch

Brookfield Watch is an organization registered with Elections Canada as a third party for the current federal by-elections. Brookfield Watch is independent of political parties and candidates. Its activities may include regulated advertising and other regulated activities under the Canada Elections Act.

Permitted Use

You may use BrookfieldWatch.com only for lawful purposes. You must not attempt to interfere with the website, gain unauthorized access to any system or data, introduce malicious code, impersonate another person or entity, submit false information, or use the website in a way that infringes the rights of Brookfield Watch or any third party.

Contribution Eligibility

Brookfield Watch accepts only contributions that it may lawfully accept for regulated activities. Under the rules currently applicable to these by-elections, eligible sources include individuals who are Canadian citizens or permanent residents and businesses or other organizations that operate in Canada. Foreign entities and foreign funds may not be used to finance regulated activities.

There is currently no limit on the amount an eligible contributor may contribute to a registered third party for regulated activities. Brookfield Watch may request information or documentation reasonably required to verify a contributor’s identity, address, contributor type, authority to act for an organization or eligibility. Brookfield Watch may refuse, hold or return a contribution if it cannot verify that the contribution may lawfully be accepted.

Nature and Use of Contributions

A contribution to Brookfield Watch is a gratuitous gift made to support Brookfield Watch’s campaign and regulated activities. It is not a purchase, investment, membership interest or payment for goods or services. Brookfield Watch will determine how contributions are allocated among lawful campaign expenses and activities, subject to the Canada Elections Act and other applicable law.

If campaign circumstances change, Brookfield Watch may redirect funds among its lawful activities or handle remaining funds as permitted or required by applicable law. A contribution does not entitle the contributor to direct Brookfield Watch’s strategy, messages, advertising, vendors or spending decisions.

No Tax Credit or Charitable Receipt

Contributions to Brookfield Watch are not eligible for a federal political contribution tax credit. Brookfield Watch is not a registered charity, and no charitable receipt will be issued.

Contributor Information and Reporting

You agree to provide complete and accurate contributor information and to promptly correct any material error. Brookfield Watch will collect, retain, verify, use and disclose contributor information as described in its Privacy Policy and as required for campaign administration and legal compliance.

If a contributor’s total contributions exceed $200 during the applicable reporting period, the contributor’s name, partial address and contribution amounts disclosed in Brookfield Watch’s financial return may be published by Elections Canada.

Information Sharing and Communications

As a condition of contributing through this website, you authorize Brookfield Watch to share your name and contact information with Rebel News Network Ltd for administration and communications relating to Brookfield Watch and this campaign. Promotional email, SMS/text and telephone contact permissions are presented separately and are optional.

Final Contributions and Refunds

Contributions are final and non-refundable except where Brookfield Watch determines that a transaction was unauthorized, duplicated, processed in error, legally ineligible or must otherwise be returned under applicable law. To report a suspected error, contact Brookfield Watch promptly at [email protected].

Website Content and Intellectual Property

Unless otherwise stated, Brookfield Watch owns or is authorized to use the content on BrookfieldWatch.com, including text, graphics, logos, designs, photographs and campaign materials. You may view and share public website links for personal, non-commercial purposes. No other use, reproduction, modification or distribution is permitted without authorization or an applicable legal right.

Disclaimers

BrookfieldWatch.com and its content are provided on an “as is” and “as available” basis. Brookfield Watch does not guarantee that the website will be uninterrupted, error-free or free of harmful components. Political commentary and campaign content express opinions and are not legal, tax, investment or other professional advice.

Limitation of Liability

To the maximum extent permitted by law, Brookfield Watch and its representatives will not be liable for indirect, incidental, special, consequential or punitive damages arising from your use of, or inability to use, BrookfieldWatch.com. Nothing in these Terms excludes liability that cannot lawfully be excluded.

Changes to These Terms

Brookfield Watch may update these Terms from time to time. The revised version will be posted on BrookfieldWatch.com with a new effective date. Your continued use of the website after revised Terms take effect constitutes acceptance of the revised Terms.

Governing Law

These Terms are governed by the laws of Ontario and the federal laws of Canada applicable there, without regard to conflict-of-law principles. Any dispute will be subject to the courts of Ontario, except where applicable law requires otherwise.
